Missing property or income in divorce…

When marriages are falling apart one or both spouses may try to hide assets or even income from the other spouse. This is common because when the marital partnership breaks down the parties often end up in court fighting over the property of both parties. A common misconception is that “I worked and my spouse didn’t, that is my money”. In New York state, absent a pre- or post-nuptial agreement to the contrary the income of either spouse is considered marital property and when one spouse has exclusive control over this income stream they may also be able to convert that income into property that is easily hidden or diverted away from the other spouse.
